ATTORNEY CHARLES J. HYNES ANNOUNCES GUILTY PLEA FOR
POSSESSING CHILD PORNOGRAPHY
Brooklyn, August 27, 2009 – Kings County District
Attorney Charles J. Hynes today announced the guilty plea of
Daron Kearse, 41, to two counts of Possessing a Sexual
Performance by a Child, a Class E felony. He will be
sentenced to two to six years in prison on October 7 before
Brooklyn Supreme Court Justice Cassandra Mullen. Kearse
must also register as a sex offender.
On December 4, 2007, Kearse uploaded six images
of child pornography to the Internet website,
Photobucket.com. On July 1, 2008, members of the NYPD
executed a search warrant on the defendant’s home at 314
Decatur Street and recovered multiple compact discs and DVDs
containing video images of minors engaged in sexual
conduct.
At the time of his arrest,
the defendant was the manager of the safety and security
department at The American Museum of Natural History in
Manhattan. He has one prior conviction for DWAI (Driving
While Ability Impaired) in 2003.
The case was prosecuted by
Kevin O’Donnell, Unit Chief in the Sex Crimes/Cyber Crimes
Unit. Rhonnie Jaus is Chief of the Sex Crimes Bureau.

10-YEAR SENTENCE IN ATTEMPTED KIDNAPPING
Brooklyn, August 26, 2009 –
Kings County District
Attorney Charles J. Hynes today announced the sentencing of
Bernard Mutterperl, to 10 years, for attempting to kidnap an
11-year-old girl in 2007.
Mutterperl, 21, was sentenced to 10 years in
prison, for Attempted Kidnapping in the Second Degree, 10
years for Burglary in the Second Degree, one year for
Unlawful Imprisonment, and one year for Endangering the
Welfare of a Child, to be served concurrently.
Mutterperl was convicted June 19, of attempting
to kidnap an 11-year-old girl on May 13, 2007, Mother’s Day,
as she returned home from purchasing a gift for her mother.
Mutterperl followed her into her building and up several
flights of stairs, before grabbing the girl, putting his
hand over her mouth, and attempting to take her back
outside. She fought him off in the lobby and alerted
neighbors, who caught Mutterperl down the street.
The case was prosecuted by Crimes Against
Children First Deputy Bureau Chief Jacqueline Kagan and
Assistant District Attorney Kathleen Collins. Ama Dwimoh is
Chief of the Crimes Against Children Bureau.

THREW DOG OFF ROOF

SURVIVED SIX-STORY FALL
Brooklyn, August 10, 2009 – Kings County District
Attorney Charles J. Hynes today announced the indictment of
Fabian Henderson, 19, for throwing his dog off the roof of a
New York City Housing Authority building, on June 18.
He is charged with
Aggravated Cruelty to Animals, Criminal Trespass in the
Third Degree and Overdriving, Torturing and Injuring
Animals. If convicted, he could face up to two years in
prison.
The dog, a pitbull named Oreo, survived the
six-story plunge from the roof of 28 W. 9th
Street, where Henderson lives. Oreo suffered multiple
fractures in her two front legs, severe ligament damage,
bruised lungs, a fractured rib, liver injury and internal
bleeding.
Neighbors called police after seeing the dog
lying on the ground. Officers took Oreo to the Veterinary
Emergency and Referral Group where she was stabilized. She
was then transported to Bergh Memorial Animal Hospital, an
ASPCA hospital, where she underwent surgery. Oreo is
currently under the care of the ASPCA, which is searching
for a family to adopt her. After an investigation,
Henderson was arrested on July 31.
An indictment is an accusatory instrument and
not proof of a defendant’s guilt.
The case is being prosecuted by Assistant
District Attorney Susan Scheuerer from the Trial Bureau Blue
Zone. Deputy District Attorney Carol Moran is Chief of the
Animal Crimes Unit. Jeffery Levitt is Chief of the Trial
Bureau Blue Zone.
