KINGS COUNTY DISTRICT ATTORNEY CHARLES J. HYNES ANNOUNCES SENTENCING OF FORMER POLICE OFFICER 

OFFICER RECEIVES FOUR YEARS FOR SEXUAL ASSAULT
 

 Brooklyn, December 17, 2007 – Kings County District Attorney Charles J. Hynes today announced the sentencing of former police officer Fernanand Clerge to four years in prison, for sexually assaulting a woman with his partner, Charles McGeean. 

Clerge, 40, was convicted September 17, of Sexual Abuse in the First Degree, Attempted Criminal Sexual Act in the Third Degree and Two Counts of Official Misconduct. 

On November 20, 2005, Clerge and McGeean, 39, stopped a woman’s car. McGeean sexually assaulted her in her car, and the officers followed her to her home in Bushwick. There McGeean touched her buttocks and Clerge groped her breasts, kissed her and tried to force her to perform oral sex on him. He then masturbated in front of her.  

Clerge’s DNA was identified in forensics samples found in the apartment and on the woman’s clothing. McGeean pleaded guilty to Official Misconduct and Sexual Abuse in the Third Degree on March 19, 2007.  He was sentenced to three years probation.  

The case was prosecuted by Kevin O’Donnell, Unit Chief in the Sex Crimes Bureau.  Rhonnie Jaus is Chief of the Sex Crimes Bureau.

KINGS COUNTY DISTRICT ATTORNEY CHARLES J. HYNES ANNOUNCES CONVICTION IN MURDER OVER GREEN-CARD MARRIAGE SCAM 

DEFENDANT FACES LIFE IN PRISON 

 Brooklyn, December 14, 2007 – Kings County District Attorney Charles J. Hynes today announced the conviction of Anderson Scrubb, 52, for murdering his wife’s 69-year-old sister. 

Scrubb committed the murder during an argument with the victim, over how much money he was to be paid for marrying her sister, as part of a Green Card scam. 

When he is sentenced, January 18, 2008, Scrubb will face up to 25 years to life in prison. 

The case was prosecuted by Assistant District Attorney Jonathan Kaye. Kenneth Taub is Chief of the Homicide Bureau.

KINGS COUNTY DISTRICT ATTORNEY CHARLES J. HYNES ANNOUNCES STARRETT CITY RAPE CONVICTION 

DEFENDANT FOUND AFTER MATCH FROM STATE DNA DATABASE 

            Brooklyn, December 11, 2007 –   Kings County District Attorney Charles J. Hynes today announced the conviction of Stanley Emerson, 48, in the rape of a 16 year-old girl in her Starrett City apartment building in 2005.  He was convicted on the top charges of Rape in the First Degree and Criminal Sexual Act in the First Degree.  He faces a maximum of 25 years in prison when he is sentenced before Justice Alan Marrus on January 3.  

            On the morning of November 4, 2005, the victim who was 16 at the time, was waiting for the elevator in her apartment building to go to school.  Emerson appeared from the stairwell, wearing a stocking over his head.  He grabbed her arms behind her back and dragged her down several flights of stairs at knifepoint into a janitor’s closet.  He then made her remove her clothes and raped her.  Then, he had her perform oral sex on him.   

            After the incident, the victim went to school and told her boyfriend.  They went to Coney Island Hospital together.  The hospital took her clothes and alerted police to the incident.  The victim’s clothing had the defendant’s semen on it.  Months later, a match came back from the State DNA database, linking the defendant to the rape.   

            The case was prosecuted by Rachel Schmidt, Deputy Bureau Chief in the Sex Crimes Bureau.  Rhonnie Jaus is Chief of the Sex Crimes Bureau.

KINGS COUNTY DISTRICT ATTORNEY CHARLES J. HYNES ANNOUNCES COLD CASE MURDER INDICTMENT

SECOND MURDER INDICTMENT FOR JACQUES DORCINVIL

             Brooklyn, December 10, 2007 – Kings County District Attorney Charles J. Hynes today announced a second murder indictment against Jacques Dorcinvil, 31, charged with murdering his girlfriend in 2003. He was also charged with murder last May, in a similar incident. 

            The indictment charges that Dorcinvil believed Maria Santiago, 34, had stolen money from him, so he stabbed her several times. He is charged with Murder in the Second Degree and Criminal Possession of a Weapon in the Fourth Degree. He faces 25 years to life in prison if convicted. 

            In May, Dorcinvil was arrested in Florida and extradited to Brooklyn to face charges in the murder of another girlfriend, Claudette Marcellus, and the attempted murder of her 12-year-old son Brian. Both victims in that incident were stabbed multiple times. 

In that case Dorcenvil faces numerous criminal charges, including Murder in the Second Degree, Attempted Murder in the Second Degree and Assault in the First Degree. If convicted he could serve an additional 25 years to life in prison. 

An indictment is an accusatory instrument and not proof of a defendant’s guilt. 

Assistant District Attorney Elisa Paisner is prosecuting the cases, for the Domestic Violence Bureau. Wanda Lucibello is Chief of the Special Victims Division.

KINGS COUNTY DISTRICT ATTORNEY CHARLES J. HYNES ANNOUNCES DOUBLE MURDER CONVICTION FOR CLUB BOUNCER 

DEFENDANT FACES 50 YEARS TO LIFE IN PRISON 

            Brooklyn, December 7, 2007 – Kings County District Attorney Charles J. Hynes today announced the conviction of Stephen Sakai, 32, on two counts of Murders in the Second Degree for two 2005 murders.  He was acquitted on a third Brooklyn murder.  He will be sentenced on January 3 before Justice John Walsh.  Sakai faces 50 years to life in prison. 

            Sakai was convicted of killing Wayne Tyson, 57, who was a patron of club Sweet Cherry where Sakai was a bouncer.  Tyson was found stabbed in his Eastern Parkway apartment on September 1.  Sakai was also convicted for the murder of Edwin Mojica, 42, who hired Sakai and worked with him at Opus 22, a nightclub in Manhattan.  He was found shot in the head in the hallway of his apartment building on November 28.  Sakai was acquitted of the murder of Irving Matos, 43, who worked with Sakai at Sweet Cherry. 

            Key evidence in the three week long trial included Sakai’s DNA which was linked to the Tyson murder. 

            Sakai is also facing trial in Manhattan for the 2006 murder of Gustavo Cuadros outside of club Opus 22.  After an argument, Sakai shot Andres Cuadros in the neck, paralyzing him.  When Andres’ brother came to his aid, Sakai shot Gustavo Cuadros in the back of the head.  This led to a shooting rampage in which two other patrons were injured.  These incidents led to proposed legislation to tighten security in NYC nightclubs. 

            The case was prosecuted by Timothy Gough, Counsel in the Homicide Bureau.  Ken Taub is the Deputy District Attorney in charge of the Homicide Bureau.

Town Hall Meeting to be Held in Canarsie, Brooklyn’s Capital for Sub-Prime Lending on Predatory Lending and the Mortgage Foreclosure Crisis on
Monday Night, 7 PM
 

Day to begin with call to action march on Wall Street led by Rev. Jesse Jackson and end with community residents speaking out and hearing from experts 

Councilman Lew Fidler, District Attorney Charles J. Hynes, and Assembly Members Alan Maisel and Helene Weinstein will co-sponsor a Town Hall meeting on predatory lending and the sub-prime mortgage crisis in the Canarsie community, the Brooklyn neighborhood with the highest incidence of sub-prime loans. The Town Hall will be held on Monday night, December 10th, at 7 PM at the HES Building located at 9502 Seaview Avenue (corner of East 95th Street, a few blocks off the Belt Parkway at the Rockaway Parkway exit). 

            Community residents are expected to tell of their problems with predatory and sub-prime loans after hearing from DA Hynes and his experts in the area of real estate fraud. Residents will also hear from the 3 legislators who all represent Canarsie. Councilman Fidler, who got his Council colleagues to fund a safety network of mortgage crisis consultants two years ago when he first predicted the sub-prime lending crisis will also introduce one of those consultants (Brooklyn Housing and Family Services) who will be there to provide individual assistance. Last week, the Bloomberg Administration and HPD announced that they will be expanding Councilman Fidler’s program in light of the crisis. 

            District Attorney Hynes’ office has aggressively prosecuted real estate fraud, which has tended to flourish as foreclosures and sub-prime loans increase. His experts will tell homeowners how to detect the telltale signs of a loan that is predatory and what to do to avoid them. 

            “Homeownership is every American’s dream and crooked mortgage brokers who prey on that dream represent one of the worst elements of our society.  My office prosecutes fraudulent lenders to the fullest extent of the law,” noted DA Hynes. 

            “Mortgage foreclosure is the biggest crisis that a family can face other than health. Yet, a wave of foreclosures doesn’t just affect that family, but entire communities. If two or three homes on a block are foreclosed upon, it affects the quality of life on that block, and real estate values too. It becomes a cancer for entire neighborhoods. That’s why this problem is so critical and why government needs to respond forcefully and effectively,” said Councilman Lew Fidler. 

            Assembly Members Alan Maisel and Helene Weinstein recently unveiled a pilot project in Brooklyn’s Housing Court, designed to expedite and mediate landlord and tenant disputes for one to three family homes. Often, foreclosures are precipitated by the unavailability of rental payments.  

"The current situation for homeowners is an absolute disaster.  I'm very pleased to be able to contribute and shine a spotlight on this growing problem for our communities”, said Assemblyman Maisel. 

“The dream of homeownership has turned into a nightmare for many borrowers who took advantage of sub prime loans, only to find themselves unable to afford the mortgages. Aggressive marketing and easy access to questionable loans has resulted in rising interest rates, decreasing property values and an alarming increase in delinquencies and foreclosures”, said Assemblywoman Helene Weinstein. 

Attendance is expected to be high given the prevalence of high cost sub-prime loans in Canarsie. The Town Hall will end a day highlighting the country’s foreclosure crisis which will begin with a March on Wall Street that is being led by the Rev. Jesse Jackson. 

“The Federal and State governments will have to respond to this crisis. It is a threat to families, to our communities and our economy,” said Councilman Fidler.
