INDICTMENT OF CIVIL DEFENSE ATTORNEY
CHARGED WITH STEALING INSURANCE
SETTLEMENT FROM CLIENT
Brooklyn, March 2, 2007
Kings County District Attorney
Charles J. Hynes today announced the indictment of Moses
Osayamwen, 49, on charges that he stole $15,000 from a
client he represented in a civil suit.
The victim suffered injuries to his back, shoulder, and
knees when he was hit by a car on Flatbush Avenue in 2000.
He hired Osayamwen and sued the driver, winning a $34,000
settlement from the drivers insurance company.
However, the indictment charges,
Osayamwen kept the money, after telling his client the
already settled suit was still pending. The settlement check
was made out to Osayamwen and his client. The attorney is
also charged with forging the victims signature in order to
cash the check.
Osayamwen is charged with Grand Larceny in the Third Degree
and Two Criminal Possession of a Forged Instrument in the
Second Degree.
If convicted, he faces seven years in prison.
Assistant District Attorneys Toni Lichstein and Joseph
DiBenedetto, of the Rackets Division, are prosecuting the
case. Michael Vecchione is Chief of the Rackets Division.

Brooklyn, March 5th, 2007 Kings County District
Attorney Charles J. Hynes today honored Brooklyns
extraordinary women with the unveiling of a huge
calendar featuring their pictures and quotations in the
lobby of the D.A.s Office. An extraordinary woman will
be featured each day throughout the month of March. The
honorees include educators, executive directors and many
other professionals nominated by Brooklyn residents.
This is an extremely diverse group of women that are
role models for the Brooklyn community. More than twenty
honorees attended the event.
March
5th honoree Audrey Velverton is known throughout the
Coney Island community as Sister Audrey. She has
devoted herself to helping others through service to her
church and the residents of Coney Island.
In
addition to her full-time work, March 8th honoree Naomi
Mauer devotes many hours to helping abused women and
women in the Jewish community that have marital
problems.
The
District Attorney will also honor all the women at a
special event at Polytechnic University on March 30th at
5:30 pm. The event will include an awards ceremony.

CONVICTION IN SEXUAL ABUSE OF 13-YEAR-OLD
HANDYMAN GAVE GIRL MONEY
AND GIFTS FOR SEX
Brooklyn, March 9, 2007 Kings County District
Attorney Charles J. Hynes today announced the conviction of
Luis Montoya, 52, on charges that he engaged in criminal
sexual acts with a 13-year-old girl.
After deliberating for two hours, a jury
convicted Montoya of Criminal Sexual Act in the Second
Degree, Attempted Rape in the Second Degree, Three Counts of
Sexual Abuse in the Second Degree, and Endangering the
Welfare of a Child. When he is sentenced March 27, he faces
up to 11 years in prison.
Montoya, a local handyman who had done odd jobs
for the girls family for 10 years, in the fall of 2005
began offering the victim money in exchange for sexual acts.
March 16, 2006, he offered the victim a video I-Pod for sex,
but was interrupted when the girls mother walked into the
apartment.
Senior Trial Attorney Sara Litman prosecuted
the case. Rhonnie Jaus is Chief of the Sex Crimes Bureau.

BOATING INCIDENT
FIRST EVER INDICTMENT ON
MANSLAUGHTER CHARGES
IN BOATING INCIDENT
Brooklyn, March 23, 2007
Kings County District Attorney Charles J. Hynes today
announced the indictment of Aristotle Plagianakos, 17, for
the death of Paul Zaccaria during a boating incident last
year. Plagianakos is charged with Manslaughter in the
Second Degree, Criminally Negligent Homicide, Reckless
Endangerment in the Second Degree and several naval law
violations related to reckless operation of a vessel. If
convicted, he faces a maximum of 15 years in prison.
According to the indictment,
on June 30, 2006, the defendant was riding his personalized
watercraft vehicle, commonly called a Jet Ski, with a
passenger in the Mill Basin inlet. They were traveling at a
high speed when they struck Zaccaria, knocking him from the
craft and killing him. Plagianakos and his passenger then
fled the scene. Zaccarias body was not found until August
6.
Several eyewitnesses observed
the incident. Plagianakos was arrested on August 31.
This marks the first time that someone
has ever been indicted in New York City for manslaughter
relating to a reckless boating incident.
An indictment is an accusatory instrument and not proof of
the defendants guilt.
The case is being prosecuted
by Gayle Dampf-Littman, Bureau Chief in the Vehicular Crimes
Bureau and Assistant District Attorney Jessica Haaz from
Trial Bureau Red Zone.
